Nespoli Funghi – Return Policy
Nespoli Funghi’s primary and sole objective is to ensure your complete satisfaction.
If for any reason you are not satisfied with your order, you may exercise your right of withdrawal, without any penalty, within 14 days from the date on which you received the purchased products.
1. Definition of Right of Withdrawal
The right of withdrawal, governed by Articles 52 and following of the Italian Consumer Code, applies exclusively to contracts concluded remotely or negotiated outside commercial premises, between a professional and a consumer.
Even in cases where the purchase was made online and later reserved for in-store pickup, the right of withdrawal may still be exercised. In such cases, the pickup is considered a contract execution phase and does not alter the nature of the contract, which was concluded remotely.
2. Nespoli Funghi’s Return Policy and Exceptions
Certain products sold by us are exempt from the right of withdrawal, in accordance with Article 59 of the Consumer Code, as they are sealed goods that are not suitable for return due to health protection or hygiene reasons and may have been opened or tampered with after delivery. For this reason, customers must carefully follow the return instructions provided.
Additionally, Article 47, paragraph 2 of the Consumer Code states that the right of withdrawal does not apply to contracts negotiated outside commercial premises in which the consumer is required to pay no more than €50 ("low-value contracts"). An exception to this rule applies if multiple contracts are signed at the same time between the same parties and the total amount owed by the consumer exceeds €50, regardless of the value of individual contracts.
3. How to Exercise the Right of Withdrawal
Despite the exceptions described in section 2, which may make the return policy inapplicable to some of our products, as a user you may withdraw from the purchase within fourteen (14) days from the date you received the products, by sending an email or registered letter to our headquarters.
This right applies to all products not marked as “non-returnable” on our website. This status will be indicated on the relevant product detail page.
The burden of proof regarding the correct and timely exercise of the right of withdrawal lies with the consumer. Therefore, communication by email or other durable telematic means will demonstrate your intention and timing. Nespoli Funghi will confirm receipt of your request and send you a return authorization number via email.
Products may be returned using the courier specified by the Seller (at no cost to you), or using another courier of your choice, but only after receiving your return number and provided that the conditions listed in section 4 below are met.
4. Conditions for Exercising the Right of Withdrawal
The right of withdrawal shall be deemed correctly exercised only if the following conditions are fully met:
a. The return request must be submitted in writing to nespolifunghi@yahoo.it, certified email nespolifunghi@legalmail.it, or by registered mail to Via Spaventa 76 – 24122 Bergamo, Italy, within fourteen (14) days of product receipt.
Or, as provided in Article 52 of the Consumer Code, in the case of sales contracts, from the day the consumer or a third party (other than the carrier and designated by the consumer) acquires physical possession of the goods, or:
for multiple goods ordered in one order but delivered separately, from the day of receipt of the last item;
for goods consisting of several lots or pieces, from the day of receipt of the last lot or piece.
b. For hygiene and safety reasons, opened products cannot be refunded. Products that are altered, damaged, customized, or improperly stored—compromising the seal—cannot be returned for health and hygiene reasons.
c. The consumer is solely liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
d. The guarantee seal and labels (for preserved products) must be intact and undamaged. All products sold are equipped with a guarantee seal, which is an integral part of the item. Do not return products without this seal, as we cannot accept returns of items without it for hygiene and health protection reasons.
e. Products must be returned in their original packaging.
f. Returned items must be shipped from the same country and location where the original order was placed.
g. The consumer must return the goods within fourteen (14) days from the date they notified the Seller of their decision to withdraw. This deadline is considered met if the goods are shipped before the end of the 14-day period.
If all conditions are met, Nespoli Funghi will refund the cost of the purchased products.
If your return does not meet the conditions listed above, we will contact you. In such cases, you may choose to have the products sent back to you at your own expense. If you decline, the Seller reserves the right to retain the products and the purchase amount.
5. Return Shipping Conditions
Returns can be shipped via the courier specified by the Seller, using the prepaid label and instructions you will receive upon confirmation of your return request.
With this method, Nespoli Funghi will cover the cost of return shipping on your behalf.
Please note that the initial delivery charges (if applicable) are non-refundable and will be deducted from the final refund amount.
If you choose to use a different courier, you must pay the return shipping costs directly and will be responsible for any loss or damage to the products during transport.
6. Refund Timing and Method
Once your return has been received and inspected by the Seller to verify that all requirements are met, you will receive an email confirmation of return acceptance.
Regardless of the payment method used (credit/debit card or cash on delivery), the refund will be processed within fourteen (14) days of receiving the return. Unless the Seller has offered to collect the goods, the refund may be withheld until the goods have been received or the consumer has provided proof of return shipment (Article 56 of the Consumer Code).
Nespoli Funghi cares deeply about customer satisfaction and will promptly refund the consumer once compliance with the return policy is confirmed.
Refund timeframes vary depending on your original payment method:
- Credit/debit card: refund times depend on your card issuer, but usually appear within two billing statements. The refund date will match the original charge date, so you won’t incur interest losses.
- Cash on delivery (if available): the refund will be made to your bank account. Timing depends on the accuracy of the bank details provided. Refunds usually appear within fourteen (14) days. Note: you must have a bank account to receive a refund; no cash refunds are issued.
- PayPal (if available): the refund will be issued to your PayPal account and will be visible immediately. The timing of the refund to your credit card depends on your card issuer.
- Other methods (e.g., Satispay – if available): refunds will be processed according to the provider’s specific procedures.
