INFORMATION TO CUSTOMERS, SUPPLIERS AND CONSULTANTS REGARDING THE COLLECTION OF PERSONAL DATA

In implementation of EU Regulation 2016/679 (hereinafter, GDPR) relating to the protection of natural persons with regard to the processing of personal data and current regulations,

of the following information relating to the processing and protection of your personal data.

Data controller

The data controller is Nespoli Funghi di Moscheni Michela (hereinafter “owner” or “company”), with registered office in Via Silvio Spaventa, 76 24122 Bergamo BG – ITALY, VAT number 04060060169 and Tax Code MSCMHL80M47A794S.

Nature of the data processed

The data processed are your personal, fiscal and economic data, necessary for the performance of existing and future contractual relationships.

The company is the owner of the processing of personal data communicated by you which includes in various capacities:

1. Company name/surname and name,

2. tax code and other identification numbers,

3. bank details,

4. address of the registered office or residence,

5. email address,

6. certified email address,

7. company and/or personal telephone numbers of representatives/owners.

Purpose of the processing

The data processing is carried out by the company in carrying out its economic and administrative activities in compliance with current legislation. In particular, the data stored and collected from interested parties will be processed by the company for the following purposes:

1. Commercial, accounting, fiscal and contractual obligations

a) The processing relating to accounting and tax obligations is necessary for a legal obligation to which the data controller is subject;

b) the processing relating to contractual obligations is necessary for the execution of a contract of which the interested party is a party or for the execution of contractual and pre-contractual measures adopted at the request of the interested party;

c) the processing for the sending of future communications on commercial and promotional promotions, announcements of offers from the owner and for the sending of any informative and promotional messages relating to the activity through the aid of traditional communication channels or with more innovations such as email and instant messaging.

2.Treatment methods

The data processing takes place through the use of tools and procedures suitable to guarantee security and confidentiality and may take place via paper media or with the aid of automated IT means suitable for the management, archiving, conservation and transmission of the data itself.

Recipients

The data collected will not be disclosed or disseminated.

Communication to third parties is foreseen for:

• public bodies for legal compliance, bodies, professionals and companies appointed by the data controller connected to the fulfillment of the administrative, accounting and management obligations linked to the ordinary performance of the company's economic activity (Companies that provide IT services for accounting management, in implementation of Law 205/ 2017, Cloud Provider, company providing back-up services and/or management and maintenance of IT equipment, software and application programs), also for credit recovery purposes if necessary

• third-party subjects and companies, such as sector consultants, credit institutions, insurance companies, contractual consultancy companies, transport and forwarding companies, third-party supply companies and technical and IT assistance.

• The data may be communicated to subjects who carry out control, audit, certification and tax and judicial consultancy services if necessary.

The data will be processed, to the extent necessary, by authorized personnel duly instructed and trained by the Data Controller.

Obligation or right to provide data

As regards the purposes indicated in points a) and b), the provision is mandatory in order to fulfill the obligations established by law, failure to provide them on your part will make it impossible to establish or continue the contractual relationship, since the same are necessary and essential for its implementation.

For the purposes listed in point c), however, the provision is optional.

However, refusal of the aforementioned contribution determines the impossibility of becoming aware of news and offers promoted by the company.

Storage

The data will be stored for the entire period in which there is a commercial and contractual relationship with the customer. The minimum retention period is 10 years from the last supply or contract management.

The data will be stored to fulfill regulatory obligations and pursue the aforementioned purposes.

The owner, after the period indicated above from the termination of the contractual relationship, undertakes to cancel, destroy or keep them anonymously for statistical purposes only.

Rights of the interested party

Articles 15 to 22 of the EU GDPR 679/2016 and art. 7 Privacy Code, they give you specific rights.

Specifically, you have:

- RIGHT OF ACCESS. Receive confirmation of the existence of data concerning you e access their content;

- RIGHT OF CORRECTION. Update, modify and/or correct the Data concerning you;

- RIGHT TO BE FORGOTTEN. Request the deletion of data concerning you

- RIGHT TO LIMITATION. Request the limitation of the use of the data processed in violation of the law including those whose conservation is not necessary in relation to to the purposes for which the Data was collected/processed

- RIGHT TO OBJECT. You have the right to object to the processing of your Data;

- RIGHT TO COMPLAIN. It is your right to lodge a complaint with the Supervisory Authority, Guarantor of privacy, if it believes there is a violation of the regulations regarding the protection of data personal data.

- RIGHT TO DATA PORTABILITY. Receive a copy in electronic or paper format of the Data concerning you as an interested party (provided in accordance with the law) and request that such Data is transmitted to another data controller.
